Important notices about The RMBIS Personal
Portfolio Service, the RMBIS FundShop Service and the International Investment Option Service
The website contains information about both the RMBIS Personal Portfolio
Service, RMBIS FundShop Service and the International Investment Option Service. The following important notices apply.
-
If you have entered into a contract with RMB, the protections provided to you
as an investor will be those applicable under the laws of the Island of
Guernsey. Protections may or may not be provided by the rules on investor
compensation that apply to the underlying investment funds in which you invest.
For example, investors in specific collective investment schemes established in
Guernsey that are Class A schemes are eligible for the payment of compensation
under The Collective Investment Schemes (Compensation of Investors) Rules 1988
(as amended) made under The Protection of Investors (Bailiwick of Guernsey) Law
1987. Similarly, investors in specific collective investment schemes
established in Jersey that are recognised schemes are eligible for the payment
of any compensation under The Collective Investment Funds (Jersey) Law 1988.
Whether a collective investment scheme is subject to rules that provide
investor compensation will be stated in the relevant collective investment
scheme's prospectus, which you as an investor may wish to independently
consult.
-
Neither the RMBIS Personal Portfolio Service nor the RMBIS FundShop Service nor the International Investment Option Service is
available to residents, nationals or citizens of the United States of America
or US Persons (as that term is defined in Regulation S of the US Securities Act
of 1933 (as amended)), nor are they available to a person who for tax purposes is resident in any European Union member country.
-
Neither the RMBIS Personal Portfolio Service, the Strategic Portfolios (if any)
offered within the RMBIS Personal Portfolio Service, nor the RMBIS FundShop
Service nor the International Investment Option Service are collective investment schemes. Each investor will hold a separate
portfolio of units or shares in the underlying investment funds. Each portfolio
constitutes a restricted range of investments to the extent that not all
investment funds available in the market have been included for
consideration.
-
The investment funds in the RMBIS Fund List will be selected from:
-
authorised unit trusts in the United Kingdom;
-
open-ended investment companies in the United Kingdom;
-
collective investment schemes which are "recognised schemes" for the purposes
of the United Kingdom's Financial Services and Markets Act 2000;
-
"unregulated collective investment schemes" for the purposes of the United
Kingdom's Financial Services and Markets Act 2000;
-
closed-ended investment companies;
-
unit trusts that are authorised or regulated by the financial services
authorities in the jurisdiction of their establishment; and
-
open-ended investment companies that are authorised or regulated by the
financial services authorities in the jurisdiction of their establishment.
Since certain of the investment funds in the RMBIS Fund List may be unregulated
collective investment schemes for the purposes of the United Kingdom's
Financial Services and Markets Act 2000, the promotion of such investment funds
is restricted by Section 238(1) of the United Kingdom's Financial Services and
Markets Act 2000 and they are not available to the general public in the United
Kingdom. An investor's choice of investment funds from the RMBIS Fund List may
therefore be restricted.
-
A fund manager may restrict the categories of people to whom any investment
fund may be offered. Depending on the investor's personal circumstances, the
investor may therefore be prohibited from applying for, or being provided with
detailed information about, certain investment funds. In addition, an
investor's choice of investment funds may be restricted by the law that applies
in either your location or the investor's country of citizenship, residence or
domicile. If the investor has any doubt about whether or not a particular
investment fund may be promoted to him/her/it or whether or not the investor
may invest in a particular investment fund, the investor should seek advice
from his/her/its professional advisor.
-
You are reminded that:
-
Past performance of any investment is not necessarily a guide to the future.
-
Fluctuations in the value of the underlying securities and the income from them
and changes in interest and exchange rates mean that the value of your
investment and any income arising from it may fall as well as rise and is not
guaranteed.
-
Deductions of charges and expenses mean that you may not get back the amount
you invested.
-
The fees charged by RMB and the underlying fund managers are not guaranteed to
remain at current levels and may change in the future.
-
The risks inherent in investments which are higher-risk investments are greater
than for other investments. Such higher-risk investments may be subject to
sudden and large falls in value. You could get back nothing at all. Higher risk
investments include, but are not limited to, investments in smaller companies
(even in developed markets), investments in emerging market or investments in
single country debt, investments in equity investment funds and investments in
high yield or non-investment grade debt.
-
Your investment portfolio may contain shares or units in funds that invest
internationally. Changes in the rates of exchange between currencies may cause
your investment and the income arising from it to go down or up.
-
There can be no assurance that the performance of the investment funds that you
invest in will achieve your stated objectives.
-
If an investment fund within your portfolio suspends dealings, your investment
may be difficult to realise and it may be difficult to obtain reliable
information about the value of your investment or the extent of the risks to
which your portfolio may be exposed. Whilst the investment fund may be listed
on an exchange, you should be aware that this may not provide an effective
trading market for such an investment.
-
If an investment fund within your portfolio is a non-daily dealing investment
fund, your investment may be difficult to realise other than on one of the
investment fund's dealing days and it will not be possible to obtain reliable
information about the value of your investment other than as at the valuation
points associated with the fund's dealing days.
-
If an investment fund within your portfolio is an investment fund that is an
unregulated collective investment scheme, the relevant investment fund may not
be subject to the same regulatory regime, in some or in all respects, including
any compensation arrangements, as is applicable to investment funds that are
available to the general public in the United Kingdom. Certain unregulated
collective investment schemes may permit a greater degree of leverage than is
permitted with investment funds that are available to the general public in the
United Kingdom. Accordingly, the underlying volatility of the investment fund
will be significantly greater than would have been the case without the
permitted leverage. Whilst this leverage gives the investment fund the ability
to participate in high returns associated with greater exposure, it also gives
increased exposure to the risk of loss.
Before making investments in collective investment schemes, investors should
obtain and carefully read the relevant prospectuses, which contain additional
information needed to evaluate the investment, and which provide important
disclosures regarding risks, fees and expenses.
